On May 3, 2024, President Biden issued a Major Disaster Declaration (“Presidential Declaration”) for Nebraska. The Federal Emergency Management Agency (FEMA) designated 2 Nebraska counties (Douglas and Washington) as areas eligible for individual assistance from the federal government. The Nebraska Investment Finance Authority has notified Owners of § 42 rental housing developments that under Internal Revenue Procedure 2014-49, they may offer emergency temporary housing to Displaced Individuals without regard to the § 42 income requirements. A Displaced Individual is defined as someone who has been displaced from their principal residences by the disaster (which residences are or were located in the Nebraska counties approved for Individual Assistance by FEMA). Development owners may request approval from NIFA to provide temporary emergency housing to displaced individuals by submitting the Owner Request to Provide Emergency Housing form located at nifa.org/developers-property-managers/forms-docs.
